Michigan has a Medical Malpractice Act which sets forth very specific requirements for filing a case. Before a medical malpractice claim can be filed, you must have an Affidavit of Merit from a doctor with the same licensure level as the defendant stating that it is a case where the defendant violated the standard of care and harmed the patient. In addition, you have to file a Notice of Intent which lets the doctor or hospital know that you intend to pursue a claim and what the claim is all about. The Notice of Intent must be filed in a timely manner or your case can be time barred.
